By accessing or using dbTAGS ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, customers, merchants, and contributors of content.

2. Service Description

dbTAGS is a subscription-based software-as-a-service platform that enables users to:

• Design and create labels with QR codes, barcodes, and custom content
• Manage inventory items and data
• Import and export data via CSV
• Generate high-resolution PDFs for printing
• Collaborate with team members (Business plan)

3. Account Registration

To use the Service, you must:

• Create an account by providing accurate and complete information
• Maintain the security of your account credentials
• Be at least 16 years of age (or have parental consent)
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized use

4. Subscription Plans and Payment

4.1 Subscription Tiers

We offer the following subscription plans:

• Free: 20 items, 3 print profiles
• Home: $9.90/month - 100 items, 10 print profiles
• Pro: $19.90/month - 250,000 items, 100 print profiles
• Business: $39.90/month - 1,000,000 items, 1,000 print profiles, unlimited users

4.2 Payment Terms

• Subscriptions are billed monthly in advance
• Payments are processed securely through Stripe
• All prices are in USD unless otherwise stated
• Prices may change with 30 days' notice
• Refunds are handled on a case-by-case basis

4.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will continue to have access to the Service until the end of the period you've paid for.

5. Usage Limits and Restrictions

Your subscription plan includes specific limits on:

• Number of items you can store
• Number of print profiles you can create
• Number of users (Business plan allows unlimited)

You agree not to:

• Exceed your plan's limits without upgrading
• Use the Service for illegal purposes
• Attempt to reverse engineer or hack the Service
• Share your account credentials with others
• Use automated systems to access the Service without permission

6. User Content and Intellectual Property

6.1 Your Content

You retain ownership of all content you create, upload, or store in the Service. You grant us a license to use, store, and process your content solely to provide the Service.

6.2 Our Intellectual Property

The Service, including its design, features, and functionality, is owned by dbTAGS and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works of the Service.

7. Prohibited Uses

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit harmful code, viruses, or malware
• Harass, abuse, or harm others
• Spam or send unsolicited communications
• Impersonate others or provide false information
• Interfere with or disrupt the Service

8. Service Availability and Modifications

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. The Service may be unavailable due to:

• Scheduled maintenance
• Technical issues or outages
• Force majeure events

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the 12 months preceding the claim
• We are not responsible for data loss, though we maintain regular backups

10. Indemnification

You agree to indemnify and hold harmless dbTAGS, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account immediately, without prior notice, if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Fail to pay subscription fees
• Use the Service in a manner that harms us or other users

Upon termination, your right to use the Service will cease immediately. We may delete your account and data after a reasonable retention period.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of [Your Jurisdiction].
